Overview

This Acceptable Use Policy ("AUP") governs your use of Notifyra services operated by INTERMEDIATE HOLDINGS OF NEW JERSEY LLC. By using our services, you agree to comply with this policy.

This AUP protects our platform, our users, and the broader community from harmful activities. We may update this policy as needed to address emerging issues or legal requirements.

Prohibited Activities

1. Spam & Unsolicited Communications

You may NOT:

  • Send unsolicited messages (spam) to individuals who have not opted in
  • Purchase or rent contact lists from third parties
  • Add contacts without their explicit consent
  • Ignore STOP/unsubscribe requests
  • Use harvested, scraped, or stolen email addresses or phone numbers
  • Send messages at excessive frequencies
  • Use deceptive practices to obtain consent

2. Illegal Activities

You may NOT use Notifyra for:

  • Any illegal activity under federal, state, or local laws
  • Drug sales or distribution (including prescription drugs without license)
  • Weapons, ammunition, explosives sales
  • Money laundering or financial fraud
  • Identity theft or impersonation
  • Copyright, trademark, or patent infringement
  • Unauthorized access to computer systems (hacking)
  • Child exploitation or child sexual abuse material (CSAM)

3. Fraudulent or Deceptive Practices

Prohibited:

  • Phishing attempts or social engineering
  • Pyramid schemes, multi-level marketing (MLM), or "get rich quick" schemes
  • Fake or misleading offers
  • Impersonating Notifyra, employees, or other organizations
  • False claims or testimonials
  • Deceptive subject lines or sender information
  • Bait-and-switch tactics

4. Adult Content & Services

Not allowed:

  • Pornography or sexually explicit content
  • Escort services or prostitution
  • Adult dating or hookup services
  • Sex toys or paraphernalia (without age verification)
  • Content involving minors in any sexual context

5. Hate Speech & Violence

Strictly prohibited:

  • Content promoting hate, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
  • Threats of violence or harm
  • Terrorist content or recruitment
  • Content glorifying violence or self-harm
  • Harassment, bullying, or stalking

6. Malicious Software & Security Threats

Do NOT:

  • Distribute viruses, malware, ransomware, or trojans
  • Include malicious links or attachments
  • Attempt to exploit security vulnerabilities
  • Conduct denial-of-service (DoS) attacks
  • Use the platform to probe or scan systems

7. System Abuse & Resource Violations

Prohibited:

  • Excessive API calls or rate limit violations
  • Using the service for cryptocurrency mining
  • Creating multiple accounts to bypass restrictions
  • Sharing accounts or credentials with unauthorized users
  • Reverse engineering or decompiling the platform
  • Attempting to bypass security controls
  • Scraping or automated data collection beyond API

8. High-Risk Financial Services

Restricted without approval:

  • Cryptocurrency exchanges or trading platforms
  • Payday loans or high-interest lending
  • Investment schemes or unregistered securities
  • Debt collection (without proper licensing)
  • Gambling or online casinos

9. Intellectual Property Violations

You must:

  • Respect copyright, trademark, and patent rights
  • Not share pirated software, movies, music, or books
  • Not use copyrighted images without permission
  • Not impersonate brands or use their logos without authorization

10. Regulatory Compliance Violations

You must comply with:

  • TCPA (Telephone Consumer Protection Act) for SMS
  • CAN-SPAM Act for email
  • GDPR for EU contacts
  • CCPA for California contacts
  • Industry-specific regulations (HIPAA for healthcare, FINRA for finance)

Acceptable Uses

Notifyra is designed for legitimate business communications:

  • Marketing Campaigns: To opted-in subscribers with proper consent
  • Transactional Messages: Order confirmations, shipping notifications, account updates
  • Appointment Reminders: Healthcare, service businesses, consultations
  • Customer Support: Help desk, service requests, issue resolution
  • Event Notifications: Webinars, conferences, community events
  • Educational Content: Courses, tutorials, newsletters
  • Internal Communications: Team notifications, employee updates
  • Non-Profit Outreach: Fundraising, volunteer coordination (with consent)

Content Standards

All messages sent through Notifyra must:

  • Be truthful and not misleading
  • Clearly identify the sender
  • Provide easy opt-out instructions
  • Respect recipient preferences and consent
  • Include accurate contact information
  • Be appropriate for all audiences (unless age-verified)
  • Comply with applicable laws and regulations

Monitoring & Enforcement

Notifyra reserves the right to:

  • Monitor account activity for compliance
  • Review message content for policy violations
  • Investigate reports of abuse
  • Suspend or terminate accounts violating this AUP
  • Report illegal activities to law enforcement
  • Refuse service to any user at our discretion

Consequences of Violations

Depending on the severity, violations may result in:

  1. Warning: First-time minor violations receive a warning
  2. Temporary Suspension: Account access disabled while under review
  3. Feature Restrictions: Limit certain features (e.g., sending volume)
  4. Permanent Termination: Account closed, no refunds issued
  5. Legal Action: Civil or criminal prosecution for serious violations
  6. Reporting: Notify authorities, carriers, or email providers

Reporting Abuse

If you believe someone is violating this policy, please report it:

  • Include: Evidence (screenshots, message copies), account/phone/email if known, description of violation
  • Response Time: We review reports within 24-48 hours

All reports are kept confidential. We appreciate your help in keeping our platform safe and compliant.

Carrier & Email Provider Requirements

Our messaging providers (Twilio, Telnyx, AWS Pinpoint, AWS SES, SendGrid) have their own acceptable use policies. You must also comply with:

  • Mobile carrier guidelines (AT&T, T-Mobile, Verizon, etc.)
  • Email provider standards (spam thresholds, authentication)
  • Industry best practices and codes of conduct

Violations may result in our account being suspended by providers, affecting all users. We take compliance seriously.

Changes to This Policy

We may update this Acceptable Use Policy at any time. Material changes will be communicated via email and displayed in your account dashboard. Continued use of the service after changes constitutes acceptance.
